By placing an order or using wishfigure.com, you ("Customer") agree to these Terms with WishFigure Studio ("WishFigure", "we", "us"). Please read carefully because custom-made products carry rules that mass-produced goods do not.
1. The Product
Each WishFigure piece is a hand-finished decorative collectible, 18cm tall (about 7 inches), sculpted from photo input you provide after checkout. Each figurine is $249. The gift-ready box is one $50 add-on per order and fits up to 3 figurines, so one figurine with the box is $299, two with the box is $548, and three with the box is $797. The product is intended for adults aged 14+ as a display piece, not a toy. Specifications are accurate to within reasonable studio tolerances; small variations and visible 3D-print artifacts such as fine layer lines, micro-seams, and mild packaging odor are inherent to handcraft and disclosed in our Craft & Care Notes.
2. Order Process
- You complete checkout first, then reply to the order email with one or more photos and any pose, nameplate, outfit, pet, accessory, or special instructions, ideally the same day.
- If the order email is hard to find, you may use the photo submission page or contact support with your order number.
- Within 48 hours after usable photos and notes are received, we send a digital design preview.
- One preview revision is included before production starts. Additional revisions are available as a paid add-on.
- Once you approve the preview, production begins and the order becomes non-cancelable, subject to our refund policy.
- Custom production and DDP shipping usually take about 3-4 weeks after preview approval, depending on complexity and destination.
- Express rush handling and photo swaps after design starts are paid value-added services; contact support before requesting them.
3. Photo Rights, Restrictions, and Customer IP Liability
By sending any photo or other reference material, you represent and warrant that:
- You either took the photo or have the explicit permission of the photographer and every identifiable person in it, including portrait rights, right of publicity, and right of likeness.
- The reference material does not infringe any third party's copyright, trademark, patent, name rights, likeness rights, or other intellectual property rights.
- The photo does not depict copyrighted characters, celebrities, public figures, trademarked logos, or other protected IP unless you have clear rights to use them.
- The photo is not unsafe, defamatory, illegal, hateful, exploitative, or otherwise unsuitable for custom production.
Customer assumes full legal responsibility for IP and personality-rights compliance. Given the volume of orders, WishFigure cannot pre-screen each upload exhaustively. If your submission infringes a third party's rights and a claim arises, you bear sole legal liability and indemnify WishFigure against any loss, damage, fee, settlement, or judgment arising from that submission. We may decline, pause, or cancel any order suspected of violating these rules. If a violation is discovered after production starts, you may forfeit any refund.
4. Pricing and Payment
All prices are in US Dollars. Payment methods are shown in Shopify Checkout; PayPal is available where displayed at checkout. Shipping, duties, taxes, and destination-specific charges are governed by the shipping policy and checkout details shown for your address.
5. Shipping, Risk of Loss, and Transit Issues
Title and risk of loss pass to the Customer when the package is delivered to the address you provided. If the entire package is lost or damaged in transit, contact us within 7 days of delivery for review. See our Shipping Policy.
Small-structure transit damage: Some figurines have small accessories or appendages that, despite shock-padded packaging, can occasionally detach or break in transit. This is resolved case by case through repair guidance, partial discount, replacement part, affected-part remake, full remake, or refund depending on the issue and evidence. It does not automatically create a full-order refund.
6. Returns, Cancellations, and Refunds
Because each figurine is custom-made for one buyer, orders are non-returnable after preview approval. Damage on arrival or substantial deviation from the approved preview is reviewed for remake, replacement, partial compensation, or refund. Full details are in our Refund Policy.
7. Intellectual Property and Display Rights
You retain ownership of your submitted photo. We retain ownership of the sculpted 3D model files, production files, process files, and their derivatives.
Display default: By default, finished figurines may be photographed and shared on WishFigure's website, social platforms, ads, email, and partner channels for marketing purposes. We do not publish the customer's original personal photos as marketing material.
Opt out: If you do not want your finished figurine shown publicly, please tell us before we send the design preview. Email support@wishfigure.com with your order number and the words "no display". We will mark your order accordingly.
8. Limitation of Liability
To the maximum extent permitted by law, WishFigure's total liability for any claim arising out of or related to your order is limited to the amount you paid for that order. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
9. Warranty Disclaimer
Except as expressly stated, our products are provided "as is" with no implied warranty of merchantability, fitness for any particular purpose, non-infringement, or uninterrupted availability, to the extent allowed by law.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict of laws provisions. Disputes will first be addressed by good-faith negotiation. If a dispute cannot be resolved informally, it will be resolved by binding arbitration on an individual basis unless applicable law requires otherwise. Class actions and representative actions are waived to the maximum extent permitted by law.
11. Changes
We may update these Terms from time to time. The latest version applies to all orders placed after the "Last updated" date shown above.
